1. Acceptance of Terms

By accessing or using the Xomi application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

2. Description of Service

Xomi is an interactive AI fiction platform that allows users to play stories and chat with AI-generated characters. The App is provided for entertainment and personal use only.

3. Eligibility — 18+ only

Xomi is intended for adults. You must be at least 18 years old (or the age of majority where you live, if higher) to use the App. By using the App you confirm that you meet this requirement. If you are under 18, please do not use Xomi.

If we learn or reasonably believe that a user is under 18, we may restrict romantic content for that account, suspend it, or close it. If you believe someone under 18 is using Xomi, please report it (see Section 8).

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate information during registration and to keep your account information up to date.

5. Acceptable Use

You agree not to:

• Use the App for any illegal or unauthorized purpose
• Create, request or share any sexual or romantic content involving minors, or characters presented as minors — this is never allowed, including in role-play
• Attempt to bypass safety filters or content moderation
• Harass, abuse, or harm other users
• Upload or create content that infringes someone else's copyright, trademark or other rights
• Upload malicious content or attempt to compromise the service
• Create multiple accounts to circumvent limits or bans

6. AI-Generated Content

All character responses are generated by artificial intelligence. Characters are fictional — they are not real people. Xomi does not guarantee the accuracy, completeness, or appropriateness of AI-generated content, and AI responses should not be taken as professional advice.

7. Your Safety and Wellbeing

Xomi is not a substitute for professional help. AI characters are not therapists, doctors or lawyers, and they cannot respond to emergencies.

If you are thinking about suicide or self-harm, or you are in danger, please contact your local emergency number or a crisis line right away. You can find a free, confidential helpline in your country at findahelpline.com.

8. Reporting Content

You can report AI messages, characters, posts, comments and users from within the App (for example, the Report option on a message in a chat). Reports are reviewed by our moderation team, and we may remove content, restrict features or close accounts that break these Terms. Reports involving minors or self-harm are prioritized. You can also email support@xomi.app.

9. Subscriptions and Payments

Some features require a paid subscription. Subscriptions are billed through Google Play or the Apple App Store. Refunds are subject to the respective store's refund policy. We reserve the right to change pricing with reasonable notice.

10. Intellectual Property

The App, including its design, code, and AI models, is owned by Xomi. User-created characters and content remain the property of their creators, but you grant Xomi a license to host and display such content within the platform. You are responsible for making sure you have the rights to anything you upload or create.

11. Copyright Complaints (DMCA)

We respect intellectual property rights. If you believe content on Xomi infringes your copyright, send a notice to support@xomi.app with the subject "Copyright notice", including:

• Your name and contact details (address, phone number and email)
• A description of the copyrighted work you claim is infringed
• The location of the material on Xomi (a link, or the character or post name)
• A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law
• A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf
• Your physical or electronic signature

When we receive a valid notice we will remove or disable access to the material and notify the user who posted it. That user may send a counter-notice to the same address. We may close the accounts of repeat infringers.

12. Account Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time through the App settings. After deletion, your data is removed as described in our Help Center (deleted accounts can be restored for 30 days, after which the data is permanently removed).

13. Disclaimer of Warranties

The App is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free service.

14. Limitation of Liability

To the maximum extent permitted by law, Xomi shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App.

15. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms.
